legal advice on buying and selling property

​​Legal support throughout the entire process, such as: 

ON PURCHASE: 

  • Verification of the legal documentation: land and  tax registry, use licence or any equivalent and architectural plans of the property - verification of the legality of the property and all its constructions, in accordance with local law; 

  • Verification that the seller is legally entitled and that there are no liens or encumbrances on the property;

  • Verification and fulfillment of other legal requirements (marital consent, right of first refusal, certificate of increase in the number of co-owners, obligations towards the condominium, among others);

  • Guidance on negotiations and the purchase structure (full ownership, co-ownership, purchase through a company, etc.); 

  • Elaboration of the promissory contract of purchase and sale; 

  • Financing; 

  • Obtaining a tax number and providing advice and information on tax obligations;

  • Accompaniment in the deed or, through a power of attorney, representation in the purchase without the need for the presence of the buyer; 

  • Registration of the property in the buyer's name.

WHEN SELLING: 

  • Verification of all the property documentation required for the sale: land and tax registry, use licence or any equivalente;

  • Advice on registrations and their harmonization (land registry and tax registry); 

  • Licensing the property; 

  • Verification and fulfillment of the seller's other legal obligations (marital consent, right of first refusal, condominium certificate, energy certificate, among others);

  • Advising on pre-contractual negotiations

  • Cancellation of in rem guarantees (mortgages, usufructs, etc.);

  • Elaboration of the promissory contract of purchase and sale; 

  • Information on tax obligations - capital gains tax;

  • Accompaniment in the deed or, through a power of attorney, representation in the sale without the need for the presence of the seller; 

  • Registration of the property in the buyer's name.

Simplification of urban planning licences and real estate transactions

  • Reduction in the number of projects requiring licensing, with a subsequent increase in the number of projects requiring prior notification or exempt from prior control;

  • Elimination of the use licence procedure; and 

  • Impact on the real estate market: when transferring property in urban buildings, the obligation to exhibit the housing technical sheet and the construction or use licence was eliminated. Possibility of transacting any property, even if you don't have the necessary licences.

Who can apply?

Did you know that from December 1, 2023, applications for Portuguese nationality made by lawyers and solicitors must be completed online? And who can apply? 

1. Residents in Portugal for at least 5 years; 

2. Children of foreigners born in Portugal IF, at the time of application, they fulfil one of the following conditions:

  • 2.1. One of the parents has resided in Portugal for at least five years, regardless of title;

  • 2.2. one of the parents is legally resident in Portugal; or

  • 2.3. The underage has attended at least one year of pre-school, primary, secondary or vocational education in Portugal. 

​3.  Descendants of Portuguese natives; 

4. Community members of Portuguese ancestry; 

5. Foreigners who have provided or are required to provide relevant services to the Portuguese State or the National Community; 

6. Descendants of Portuguese Sephardic Jews; and 

7. Ascendants of native Portuguese citizens who have resided in Portugal, regardless of title, for at least five years.
